1. Acceptance of Terms

By accessing or using Hire Kayla (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Hire Kayla provides AI-powered phone automation for small businesses. Our Service includes AI phone agents that handle inbound and outbound calls, call analytics, transcription, and related tools accessible through our web dashboard.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old and a legal entity or authorized representative to use the Service
• One person or business may not maintain more than one free trial account

4. Subscription & Billing

• The Service offers multiple subscription tiers with varying features and call limits
• Subscriptions are billed monthly through Stripe. You authorize us to charge your payment method on a recurring basis
• Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period
• Refunds are issued at our discretion and only for unused portions of service

5. Acceptable Use

You agree not to use the Service to:

• Make calls that violate any applicable telemarketing, robocall, or telecommunications laws (including TCPA, TSR, and state equivalents)
• Engage in harassment, fraud, impersonation, or deceptive practices
• Transmit illegal, harmful, or objectionable content through AI agents
• Attempt to reverse-engineer, exploit, or compromise the platform or its infrastructure
• Exceed the call volume or usage limits of your subscription plan
• Use the Service for emergency (911) calls or as a replacement for emergency services

6. AI Limitations & Disclaimer

Our AI phone agents use advanced language models but are not infallible. You acknowledge that:

• AI responses may occasionally be inaccurate, incomplete, or inappropriate
• You are responsible for training your AI agent with accurate business information
• The AI agent is not a substitute for professional advice (legal, medical, financial, etc.)
• We are not liable for any business decisions made by callers based on AI-generated responses

7. Call Recording & Compliance

Calls handled by the Service may be recorded and transcribed. You are solely responsible for:

• Complying with all applicable call recording consent laws in your jurisdiction
• Informing callers that their calls may be recorded and processed by AI
• Obtaining any required consent before using the Service for outbound calls

8. Intellectual Property

The Service, including its software, design, and content, is owned by Hire Kayla and protected by intellectual property laws. Your business content (knowledge base, call data) remains your property. You grant us a limited license to use your content solely to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Hire Kayla shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that harms other users or the platform. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
